Analysis of the State Council Regulation on Overseas Investment

On July 1, 2026, a new regulation on overseas investment will come into force in China (State Council Order No. 837). Behind an apparently economic title, the text is structured around a national security logic: it fuses investment and technological control, establishes a security review regime for outbound investments by Chinese companies, and incorporates a countermeasures component.

In this document, I break down the most relevant articles of the regulation—what they actually say and why they matter for Latin America, particularly for submarine cable projects, data centers, strategic mining, telecommunications, and digital infrastructure.
